1. Introduction & Acceptance of Terms

Welcome to BookMyGuru, an online platform owned and operated by Book My Guru LLC (“BookMyGuru,” “we,” “us,” or “our”). These Terms & Conditions (“Agreement”) govern your use of and access to:

  • The BookMyGuru.com website,
  • The BookMyGuru mobile applications, and
  • Any related services, features, or content made available by BookMyGuru (collectively, the “Platform” or “Services”).

By accessing or using the Platform, you (“User,” “Customer,” or “Guru”) agree to be bound by this Agreement, as well as our Privacy Policy, Guru Guidelines, and any other policies, rules, or disclaimers posted on the Platform (collectively, the “Terms”).

If you do not agree to these Terms, you may not access or use the Platform. By using the Platform, you also represent that you are at least 13 years old (or older if required by local law). If you are under 18, you confirm you have the consent of a parent or guardian.

2. Definitions

For clarity:

  • User / Customer – Any person using the Platform to book or purchase consultations.
  • Guru / Expert – An individual offering consultations, guidance, or expertise via the Platform.
  • Content – All materials submitted, created, or shared on the Platform, including text, audio, video, images, posts, comments, reviews, or advice.
  • Platform Content – All proprietary content owned or created by BookMyGuru, including logos, design, software, and databases.
  • Services – All tools and features enabling Users and Gurus to connect, book, and conduct consultations.

3. Eligibility & Accounts

  1. Account Creation – Users must create an account to access certain services on the Site. By creating an account, you agree to provide accurate, current, and complete information as required during the registration process. You are responsible for maintaining the confidentiality of your account details.
  2. Account Security – You are responsible for maintaining confidentiality of login credentials and for all activity under your account. Notify BookMyGuru immediately of unauthorized use.
  3. Guru Eligibility – To participate as a Guru, you must create an account and represent that you have the knowledge or experience in your chosen area of expertise. BookMyGuru may, at its discretion, request information, credentials, or identity documents to help assess eligibility, but we do not guarantee the accuracy of any such information. BookMyGuru reserves the right to suspend or terminate any Guru account if information provided is false, misleading, or incomplete.

4. Nature of Services & Disclaimers

  1. Licensed and Non-Licensed Gurus – BookMyGuru is a venue that allows individuals (“Gurus”) to share insights, knowledge, and experiences across various fields, including but not limited to business, immigration, health, fitness, education, and personal development. Some Gurus may represent themselves as licensed professionals. Unless explicitly verified and marked by BookMyGuru through a third-party verification process, BookMyGuru does not independently verify the authenticity of any Guru’s claimed credentials, licenses, or qualifications.
  2. Informational & Educational Only – Consultations are for informational, educational, or guidance purposes. They are not substitutes for licensed professional services such as medical, legal, financial, or mental health advice.
  3. No Professional-Client Relationship – Interactions on BookMyGuru do not establish a professional-client relationship between Users and Gurus. By using the platform, you acknowledge that no attorney-client, doctor-patient, or any other professional-client relationship is formed via the Site or the mobile app.
  4. User Responsibility – You are solely responsible for your decisions and actions based on advice from Gurus.
  5. Waiver of Liability – By using the Platform, you release and hold harmless BookMyGuru and Gurus from any liability, damages, or losses resulting from reliance on advice.

5. Conduct, Content & Responsibility of Contributors

  1. Acceptable Use – You agree to engage respectfully and lawfully. Do not disrupt the Platform, harm others, or violate any laws.
  2. Prohibited Content – You may not post or share:
    • Hate speech, harassment, or threatening content.
    • Pornographic, sexually explicit, or violent material.
    • Content that infringes intellectual property rights.
    • Content containing viruses, malware, or harmful code.
    • Spam, phishing, or deceptive promotional material.
  3. Responsibility of Contributors – If you publish content (profile, blogs, reviews, comments, or advice), you represent and warrant that:
    • You own or have permission for the content.
    • Content does not infringe third-party IP rights.
    • Content complies with third-party license terms, with proper attribution.
    • You will not mislead, misrepresent credentials, or deceive users.
    • Content will not contain malicious code, spam, pornography, incitement to violence, or privacy violations.
    • If created under employment, you have secured permission or waiver from your employer.
  4. AI Restrictions – Gurus may not use AI tools to generate consultation responses unless expressly permitted by BookMyGuru.
  5. Off-Platform Solicitation – Soliciting Users outside the Platform for payment or services is prohibited and may result in termination.

6. Guru Qualification & Verification

  1. BookMyGuru may, at its discretion, request information or documentation from Gurus to support their claimed credentials or expertise, which may include degrees, certifications, professional licenses, work experience, or publicly available information such as professional profiles. BookMyGuru may also use third-party services to assist in verifying certain information.
  2. However, BookMyGuru does not guarantee or warrant the accuracy, completeness, or validity of any Guru’s credentials or qualifications. Verification is limited to the information provided by the Guru or available from third parties, and BookMyGuru does not independently confirm or certify professional licenses.
  3. Users are encouraged to conduct their own due diligence before relying on any Guru’s advice. Gurus remain solely responsible for the truthfulness of the information they provide, and BookMyGuru reserves the right to suspend or terminate a Guru’s account if information is found to be false or misleading.

7. Payments, Fees, Refunds & Work Authorization

  1. Payment Models – BookMyGuru may offer per-session payments, subscriptions, or memberships.
  2. Platform Fees – BookMyGuru charges a service fee (e.g., 20%) on all transactions, deducted before Guru payout.
  3. Guru Payouts – Gurus are paid via third-party processors (e.g., Stripe, PayPal, Payoneer). BookMyGuru is not responsible for processor delays or errors.
  4. Refunds & Cancellations – Refunds are available under limited conditions (e.g., service failure, Guru no-show). Refund requests must be made promptly after the session.
  5. Taxes – Gurus on BookMyGuru are independent contractors and not employees, agents, or representatives of BookMyGuru. Nothing in these Terms creates an employer–employee relationship. As an independent contractor, you are responsible for determining whether and how you may legally offer services, and you bear all responsibility for any required registrations, permits, or authorizations. BookMyGuru may issue IRS Form 1099-NEC or equivalent if required.
  6. Work Authorization – Gurus represent and warrant that they are legally authorized to work and receive payments in their jurisdiction. BookMyGuru does not verify immigration or work authorization status.
  1. Responsibility – Failure to comply with immigration or tax obligations may result in suspension or termination of your account. BookMyGuru shall not be liable for any fines, penalties, or other consequences arising from your failure to maintain proper work authorization or comply with tax laws.
     
     
  2. Booking Terms – Gurus must accept bookings within the acceptance windows communicated by BookMyGuru. Failure to accept within the required timeframe may result in the booking expiring and the funds being returned to the Learner. Detailed rules, including acceptance timelines, fund release procedures, and payout schedules, are provided in the Booking Terms, which are incorporated into this Agreement by reference.

 

8. Intellectual Property & Content Ownership

  1. Definitions – Content includes Guru Content (advice, blogs, videos, etc.), User Content (questions, comments, reviews), and Platform Content (software, logos, design).
  2. Guru Content – Gurus retain ownership but grant BookMyGuru a worldwide, royalty-free license to use, display, distribute, and promote their content within the Platform and marketing. Gurus may not redistribute Platform-hosted content outside the Platform without written consent.
  3. User Content – Users retain ownership of their comments, questions, and reviews but grant BookMyGuru the right to use them for operational and promotional purposes.
  4. Platform Content – BookMyGuru owns all IP rights in its software, design, and brand.
  5. Prohibited Uses – No unauthorized reproduction, redistribution, or derivative works of any content. Screenshots, recordings, or external use of session content is prohibited.
  6. Violation Consequences – Unauthorized use may result in suspension, termination, and legal action.

9. Use of Name, Image & Likeness

By creating an account, you grant BookMyGuru permission to use your name, profile, image, bio, and likeness in connection with operating and promoting the Platform, including marketing campaigns.

10. Copyright Infringement (DMCA Policy)

If you believe content infringes your copyright, send a notice to legal@bookmyguru.com. BookMyGuru may remove or disable access to infringing content and terminate repeat infringers.

11. Third-Party Links & Services

The Platform may link to third-party sites or use third-party tools. BookMyGuru is not responsible for their content, security, or practices. Use them at your own risk.

12. Platform Rights

BookMyGuru reserves the right to:

  • Update, suspend, or discontinue any feature of the Platform.
  • Moderate, edit, or remove content.
  • Suspend or terminate accounts (with or without notice) for violations.
  • Investigate suspected misuse or fraud.

13. Disclaimer of Warranties

The Platform and Services are provided “as is” and “as available.”
 BookMyGuru disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted, error-free service, nor that the Platform is free of viruses or harmful code.

14. Limitation of Liability & Force Majeure

  1. Liability Cap – BookMyGuru’s total liability for any claims will not exceed the greater of: (a) the fees you paid us in the 12 months before the claim, or (b) USD $100.
  2. Excluded Damages – We are not liable for indirect, incidental, punitive, or consequential damages.
  3. Force Majeure – BookMyGuru is not liable for delays or failures caused by events outside our control, including natural disasters, strikes, cyberattacks, power outages, or government actions.

15. Indemnification

You agree to indemnify and hold harmless BookMyGuru LLC, its affiliates, officers, employees, and contractors from any claims, liabilities, damages, or costs (including legal fees) arising from:

  • Your use of the Platform.
  • Your content or advice.
  • Your violation of this Agreement or any law.
  • Any dispute between you and another User or Guru.

16. Governing Law

This Agreement shall be governed by the laws of the State of Texas, USA, without regard to conflict of law principles.

17. Dispute Resolution & Class Action Waiver

  1. Arbitration – Any disputes will be resolved by binding arbitration under the AAA Consumer Arbitration Rules, conducted in Texas, in English.
  2. No Jury Trial – You waive the right to a trial by jury.
  3. Class Action Waiver – All disputes must be brought individually. You waive the right to participate in class, collective, or representative actions.
  4. Small Claims – Either party may bring claims in small claims court if eligible.

18. Term & Termination

  1. By User – You may terminate your account at any time by contacting BookMyGuru.
  2. By BookMyGuru – We may suspend or terminate accounts at any time, with or without cause.
  3. Survival – Provisions regarding payments, IP, disclaimers, limitation of liability, indemnification, and dispute resolution will survive termination.

19. Miscellaneous

  • Entire Agreement – These Terms constitute the full agreement between you and BookMyGuru.
  • Severability – If any provision is unenforceable, the rest remain in effect.
  • Assignment – BookMyGuru may assign its rights under this Agreement; you may not assign without consent.
  • Waiver – Failure to enforce a right does not waive it.
  • Headings – For convenience only.
  • Notices – Notices will be sent via email or posted on the Platform.
